THIS NOTICE DESCRIBES HOW MEDICAL AND SUBSTANCE USE DISORDER INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED, AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

About This Notice

Colorado Recovery Homes LLC ("Colorado Recovery Homes," "we," "us," or "our") provides supervised peer support services, with workforce support also available, through our QBHA-certified and CPFS-credentialed coaching staff (CPFS credentials are administered through the Colorado Providers Association), operating under required clinical supervision, through our peer support and guidance and transitional housing serving Colorado Springs and Monument, Colorado. We bill Health First Colorado (Colorado Medicaid) for eligible services. Because we create and maintain health information about you, we are required by law to protect its privacy and to provide this notice describing our legal duties, our privacy practices, and your rights.

Scope of This Notice

This notice applies to the health information we create or receive through the peer support and guidance we provide, including any workforce support. It does not apply to matters arising solely from your separate Occupancy Agreement with us, such as fees or the terms of your transitional housing — those are governed by that agreement, not this notice. You do not need transitional housing with us to receive our support and guidance. Continued occupancy, however, requires ongoing compliance with the terms of your Occupancy Agreement, and a violation of those terms may result in removal from housing.

How We May Use and Disclose Your Health Information

For treatment. We may use and disclose your health information to provide, coordinate, and manage the coaching, peer support, and workforce services you receive, and to coordinate with other providers involved in your care.

For payment. We may use and disclose your health information to bill and obtain payment from Health First Colorado (Medicaid) for services we provide, including through our supervisory biller.

For health care operations. We may use your information for activities such as quality improvement, staff supervision and training, and licensing or compliance reviews.

For housing eligibility. Because continued occupancy of transitional housing with us requires ongoing compliance with the terms of your Occupancy Agreement, we may use information about your engagement with our support and guidance to determine your continued eligibility for housing.

Other permitted or required uses. In limited situations, and only as allowed by law, we may use or disclose your information without your written permission — for example, when required by law, to prevent a serious threat to health or safety, in response to a valid court order, or to a health oversight agency conducting an authorized review. Outside situations like these, we will ask for your written consent before sharing your information.

Special Protections for Substance Use Disorder Records (42 CFR Part 2)

Because we support clients in substance use recovery and participate in Medicaid, records that would identify you as someone who has sought or received substance use disorder services may be subject to additional federal confidentiality protections under 42 CFR Part 2, on top of HIPAA. Under Part 2, we generally may not disclose information that would identify you in this way unless you provide specific written consent, or in narrow circumstances such as a medical emergency, a court order, or as otherwise permitted by law. Information protected under Part 2 may not be used to initiate or substantiate criminal charges against you, or to conduct a criminal investigation of you, without your consent or an appropriate court order.

These Part 2 protections are narrower than, and take priority over, the general HIPAA disclosure examples described above. For instance, the "health oversight agency" and "required by law" examples above do not by themselves permit disclosure of information that would identify you as someone who has sought or received substance use disorder services — a specific Part 2 exception, your written consent, or a qualifying court order is required first.

Uses That Require Your Written Authorization

Other than as described above, we will obtain your written authorization before using or disclosing your health information for any other purpose — including most disclosures of substance use disorder records, marketing communications, or the sale of your health information. You may revoke a written authorization at any time, except to the extent we have already acted on it.

Your Rights

• Request a copy of your health record
• Request that we amend your record if you believe something is incorrect or incomplete
• Request an accounting of certain disclosures we've made of your information
• Request restrictions on certain uses or disclosures, which we are not always required to agree to
• Request confidential communications by an alternative means or at an alternative location
• Receive a paper copy of this notice at any time, even if you've agreed to receive it electronically
• File a complaint if you believe your privacy rights have been violated, without fear of retaliation

Our Responsibilities

We are required by law to maintain the privacy of your health information, provide this notice of our legal duties and privacy practices, notify you if a breach occurs that may have compromised your information, and abide by the terms of the notice currently in effect.

Changes to This Notice

We reserve the right to change this notice and to make a revised notice effective for health information we already have as well as information we receive in the future. Updated notices will be posted here and made available at each of our homes.
